Data Controller:
Legal Basis for Processing:
- Contract for the provision of legal services
- Providing personal data is the obligation of the data subject – the client (hereinafter referred to as the "client"), arising from the above-mentioned contract.
Purpose of Processing:
Provision of legal services according to the contract concluded with the client
Recipients of Personal Data:
- Public authorities (e.g., courts, administrative bodies)
- Providers of IT system maintenance
- Other recipients as needed and instructed by the client
Data Processing Period:
Personal data will be processed for the duration of the aforementioned contract and subsequently handled in accordance with applicable legal regulations, in particular Act No. 85/1996 Coll. (Advocacy Act), Act No. 499/2004 Coll. (Archives and Records Management Act), and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
Client Rights:
The right to access personal data means the client has the right to obtain information from the controller – the lawyer – on whether they are processing the client's personal data, and if so, what data it is and how it is processed. The client also has the right to have inaccurate personal data concerning them corrected without undue delay upon request. The client can supplement incomplete personal data at any time.
The right to erasure of personal data obliges the controller – the lawyer – to destroy personal data processed about the client under certain conditions and upon the client's request.
The client has the right to have the controller – the lawyer – restrict processing of their personal data in certain cases. The client also has the right to object to processing based on the legitimate interests of the controller – the lawyer, a third party, or processing necessary for public interest or exercise of public authority.
The right to data portability allows the client to obtain personal data they provided to the controller in a common, machine-readable format. The client can then transfer this data to another controller or request the controllers to transfer it directly if technically feasible.
The right to withdraw consent for data processing at any time does not apply here, as the client's personal data is processed based on the fulfillment of the contract with the client, not based on consent.
If the client is dissatisfied with the processing of their personal data by the controller – the lawyer – they can file a complaint directly with them or contact the Office for Personal Data Protection.
